GENERAL TERMS AND CONDITIONS OF SALE

These terms govern all sales made through www.arcaraparis.com.

1. The seller

2. Scope

These terms apply to every order placed on the site by a consumer. By placing an order you accept them in full. We may amend them at any time; the version in force is the one published on the site on the date your order is placed.

3. Products

Our pieces are cast by hand. Photographs are as faithful as we can make them, but minor variations in finish, colour and weight are inherent to the casting process and are not defects.

Every letter is set with a laboratory-grown diamond. Laboratory-grown diamonds have the same chemical, physical and optical properties as mined diamonds and are graded by the same standards.

4. Prices

Prices are shown in euros and include French VAT for orders delivered within the European Union.

For orders delivered outside the European Union, the price shown excludes French VAT and includes the import duties and taxes due on arrival, which we settle on your behalf. Nothing further is payable on delivery.

Prices may change at any time, but the price applied to your order is the one displayed at the time you place it.

5. Orders

The contract is formed when we send you an order confirmation by email. We may refuse or cancel an order where the product is unavailable, where there is an evident pricing error, or where we have reasonable grounds to suspect fraud or resale.

6. Payment

Payment is taken in full when the order is placed, through our payment provider. We do not have access to your card details.

The goods remain our property until payment has been received in full.

7. Delivery

Orders are dispatched from Paris within 1–2 business days. Pieces in 18k solid gold are made to order and dispatched within 4–6 weeks.

Delivery is complimentary worldwide. Delivery times by destination are set out in our shipping policy and run from the date of dispatch. They are estimates and not guaranteed dates.

Risk of loss or damage passes to you when the parcel is delivered to you or to a person you have designated. If a parcel is lost in transit, we will replace the piece or refund it.

If we have not delivered within 30 days of the order and no other date was agreed, you may cancel the order and we will refund you in full.

8. Right of withdrawal

You have 14 days from the day you or a third party you designate takes physical possession of the goods to withdraw from the contract, without giving a reason and without penalty. This applies to all pieces, including those made to order.

To exercise it, inform us of your decision by an unambiguous statement, using the model form on our withdrawal page or by writing to contact@arcaraparis.com.

You must return the goods within 14 days of notifying us. You bear the direct cost of return. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the piece.

We will reimburse all payments received from you, including the cost of standard outbound delivery, within 14 days of being informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them.

9. Commercial returns and exchanges

In addition to the statutory right above, we accept returns requested within 14 days of delivery and exchanges requested within 30 days, on the conditions set out in our refund policy. Outside the European Union, pieces in 18k solid gold are made to order and are not covered by this commercial policy.

10. Legal guarantees

You benefit from the legal guarantee of conformity (articles L.217-3 and following of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 and following of the French Civil Code).

Under the legal guarantee of conformity you have two years from delivery to act. You may choose between repair and replacement, subject to the cost conditions provided by article L.217-12 of the Consumer Code. You are exempt from proving the lack of conformity during the 24 months following delivery. The legal guarantee of conformity applies independently of any commercial guarantee.

You may decide to invoke the guarantee against hidden defects within the meaning of article 1641 of the Civil Code, in which case you may choose between rescission of the sale and a reduction of the price, in accordance with article 1644 of the Civil Code.

11. Care

Plating is a surface finish and wears with use. Wear resulting from contact with water, perfume, cosmetics, chlorine or abrasion is normal use and is not a defect. Care instructions are published on the site.

12. Intellectual property

All content on the site, including designs, photographs, text and the ARCARA name and marks, is our property or licensed to us. No reproduction or use is permitted without our written consent.

13. Personal data

Personal data is processed as described in our privacy policy. You may exercise your rights of access, rectification, erasure, portability and objection by writing to contact@arcaraparis.com.

14. Disputes In the event of a dispute, please contact us first at contact@arcaraparis.com so that we can seek an amicable solution. You may also use the European online dispute resolution platform at https://ec.europa.eu/consumers/odr.

15. Governing law

These terms are governed by French law. This does not deprive a consumer of the protection afforded by the mandatory rules of the country in which they are resident.
